Cal/OSHA Expands IIPP Guidance to Address COVID-19 in the Workplace

Title 8 of the California Code of Regulations (T8CCR) section 3203, requires every CA employer to develop and implement an effective, written Injury and Illness Prevention Program (IIPP).  A critical component of the program is that it must act to protect employees from workplace hazards, including infectious diseases.

Employers are now required to determine if COVID-19 infection is a hazard in their workplace. If it is a workplace hazard, then employers must implement infection control measures, including applicable and relevant recommendations from the Centers for Disease Control and Prevention (CDC),  Employers should consider this in conjunction with the Governor’s recent Executive Order shifting the presumption to the employer for the purposes of workers’ compensation claims for any employee that contracts COVID-19.

On Thursday, May 14th, Cal/OSHA issued expanded IIPP guidance addressing the hazards of COVID-19 in the workplace and pertaining to the hazard of COVID-19 in the workplace. As state and local “Stay at Home” orders are gradually relaxed, employers will be wise to conduct a thorough review of all safety procedures and to review and update their IIPPs to address COVID-19.

The May 14th interim guidance does not impose new legal obligations. It provides employers and workers with information for preventing exposure to the Coronavirus (SARS-CoV-2), the virus that causes COVID-19. Employers and employees should review their own health and safety procedures as well as the recommendations and standards detailed below to ensure workers are protected.
